General Terms and Conditions – Maple Capital Canada

Article 1: Applicability and Binding Force

These Terms and Conditions constitute a complete, legally binding contract between you (the "User") and Maple Capital Canada. By accessing  https://maplecapitalcanada.com or utilizing our digital services, interfaces, or analytical tools, you expressly and unconditionally agree to be bound by these Terms and our operational guidelines.

Article 2: Nature of Services (Execution-Only)

Maple Capital Canada provides an advanced technical infrastructure for data aggregation, market tracking, and digital analytical indicators.

2.1. Non-Advisory Status: We act exclusively as an independent technology and software provider. Nothing contained on this platform constitutes regulated financial, investment, tax, or legal advice, nor does it represent an offer or solicitation to buy or sell financial instruments. We are not registered as an investment dealer or portfolio manager with the Ontario Securities Commission (OSC) or any other provincial regulatory body.

2.2. User Autonomy: All financial decisions, strategies, or transaction paths executed by the User are performed entirely at the User's sole discretion, independent judgment, and exclusive risk.

Article 3: Statutory Risk Disclosure

The User explicitly acknowledges and accepts that:

High Volatility: Capital markets and digital asset sectors are subject to severe, unpredictable price fluctuations and liquidity shifts.

Capital Loss: Engaging with digital tracking and analytics systems involves inherent exposure to partial or total loss of any capital deployed in external markets.

No Performance Guarantees: Historical performance charts, data telemetry, and algorithmic probabilities offer no assurance or guarantee of future market results or profitability.

Article 4: Intellectual Property

The entire platform architecture, including custom data models, visual layouts, interfaces, source codes, proprietary algorithms, and trade names, remains the exclusive property of Maple Capital Canada. Any unauthorized reverse engineering, unauthorized replication, automated data extraction (scraping), or distribution of this property is strictly prohibited and subject to immediate legal remedy.

Article 5: Limitation of Liability

To the maximum extent permitted under applicable Canadian law, Maple Capital Canada, its directors, employees, and tech providers bear no liability for unexpected service interruptions, API latency, third-party data stream errors, system vulnerabilities, or incidents of Force Majeure (including coordinated cyberattacks, internet routing failures, or national power grid disruptions).

Article 6: Governing Law & Jurisdiction

This Agreement and any disputes arising out of it are exclusively governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action or proceeding that cannot be resolved through mutual dispute coordination shall be submitted to the exclusive jurisdiction of the competent courts sitting in Toronto, Ontario, Canada.
